Report: WWE & 2K Appealing Randy Orton Tattoo Lawsuit Verdict WWE

WWE and 2K are reportedly appealing the result of the Randy Orton tattoo lawsuit case that concluded in September 2022.

To quickly recap, in April 2018, Catherine Alexander – Orton’s tattoo artist – filed a lawsuit against WWE, Take-Two Interactive Software Inc, 2K Games Inc, 2K Sports Inc, Visual Concepts Entertainment, Yukes Co Ltd, and Yukes LA Inc.

In the lawsuit, she claimed that those parties had infringed on her copyright by using the tattoo work she did on Randy Orton in video games without her permission.

Orton himself was not a defendant in the case but did testify as a witness during the trial.

The jury for the case concluded that the defendants had not proven that the tattoos came under “fair use”, and that Alexander was entitled to $3,750 in damages.

The issue for the defendants wasn’t the money, but more the precedent the ruling set by saying the use of tattoos doesn’t come under “fair use”, because it essentially opens the door for other tattoo artists to file similar lawsuits for the use of other wrestlers’ tattoos in video games and other similar marketing/products.

According to the latest Wrestling Observer Newsletter, the defendants are attempting to get the verdict thrown out and for a new trial to take place, this time with a judge, not a jury, making the final ruling.
