WWE Hall of Famer Booker T has lost his lawsuit against Activision after claiming similarities between a Call of Duty character and GI Bro.
Booker Huffman (real name) filed the lawsuit in 2019 against Activision Publishing Inc, Activision Blizzard Inc, and Major League Gaming Corp.
In the lawsuit, he claimed that the character David ‘Prophet’ Wilkes in the Call of Duty: Black Ops 4 video game was based on the comic book version of his former pro-wrestling persona GI Bro.
He claimed that he was not contacted to give permission and the defendants had infringed on his copyright. The lawsuit also claimed the game was thought to have made over $1 billion since its release.
However, Activision argued during the litigation that Booker T had exaggerated similarities between the two characters, and the publisher basically said they just happen to be two Black military men with dreadlocks.
Acitivision also argued that Booker had signed away his rights to GI Bro to WWE, but Booker said that was only the case for use within the pro-wrestling business.
Either way, the jury decided Activision had a more persuasive argument and the publisher won the case.
E Leon Carter of Carter Arnett, Trail Counsel for Activision Blizzard, made the following statement:
“We are pleased with the outcome. Bottom line, to call this a frivolous case would be a massive understatement. Activision creates games with the utmost integrity and is extremely proud of everyone involved with the development and creative process for all of our games including Call of Duty: Black Ops 4, including the incredible talent like William Romeo who helped bring our vision to life. Today, the jury validated that process.”
